Legal Question in Family Law in Massachusetts

I filed a motion to modify support after i found out NCP had lied about income. He immediately hired an attorney and threatened to go for custody (he spent 4 months having inconsistent visitation, did not meet child until he was 18 mos, and has not seen him in almost three mos). I have yet to be served with papers, nor have i received an answer to my complaint (well over 20 days). Is it possible for him to answer my complaint for modification with a request for custody/visits, or does he need to file his own motion? Thanks in advance.

Absolutely yes. You open the door, and they can seek anything. But they must then make their case.
