Form & Process to File for Custody of Son

For my husband to file for custody of his son w/o lawyer representation, what form needs to be completed and what steps do we take after the form is complete?

The forms are all available online, or at the courts. Most of the forms you need are at http://www.mass.gov/courts/courtsandjudges/courts/probateandfamilycourt/forms.html.

You should consider engaging an attorney if there will be any fighting over this.

Assuming you want to give physical custody to your husband and he is in agreement. You file a Joint Petition for Modification of Physical Custody.

You should note this will alter any child support agreements between the two of you, such that you may have to pay him child support.

If you are both in an agreement as to what you want to accomplish, you may want to engage an attorney to assist you. The cost should be fairly reasonable if all he is doing is preparing the documents for you.
