fraud and child support

my son has been paying $500.00 a mth and medical coverage for his child since she was born(9yrs) he never married the mother she married someone else 7 yrs ago. she just got child support services after him for her and the child. she used her maiden name. she has a husband and 2 kids from him. is my son responsible for the mother ? is this not fraud on her part? does my son need a lawyer?

Your son should get a lawyer. He is not responsible to support her. He is required to pay child support. The amount he will be required to pay is based in part on his income.

If it his child, he is obligated to pay support. Her use of her maiden name, alone, is no fraud.

Your son is responsible for HIS CHILD. The mother's HUSBAND is responsible ONLY for his OWN children. How is it possibly fraud to use the name that DOR/CSE knows her by in order to get the child's FATHER to pay CHILD SUPPORT?

Your son needs to pay child support. He may want a lawyer's help in determining this, but he certainly is not entitled to make the current husband pay his own debts. Does your son also expect the current husband to pay for your son's car? Maybe his credit cards?

Yes, this is a blunt answer, but a variant of this question is asked on this board at least once a month.
