Legal Question in Family Law in Massachusetts

I have a frienf of the family that is willing to go to court with me on behalf of myself and my daughter who is 16. He is a law student, I have a support/visitation issue. Can I use him in family court to help myself and my daughter so he does not reduce his support order and he can not visit my daughter as she does not want to see him, he has not bother with her in 15 1/2 years and she has mental health issues and abandonment issues because of him. I have called legal asst and mass justice project and they can not help me. If I can is there paperwork that I would have to file or he would have to file or can I just go in and say I have my own legal represention which is the friend of the family.

Unfortunately the law student can not represent you in Court. To save on legal fees you can hire an attorney for just the hearing. If you have a question about hiring an attorney just for the hearing, do not hesitate to contact me.

Only a licensed attorney can represent another individual before a court, and your friend would not be heard by the court. He should know this. I encourage you to reach out to our office to see if we can provide the representation you are looking for. Best of luck!

If the law student is part of a clinical program that allows students to assist in such matters, he should speak with his law school about getting permission under the schools clinical program to assist you. If he cannot qualify through a clinical program then he cannot assist you in court as far as I understand the current rules. In such a case you may want to hire an attorney for the hearing.

Good luck
