Hello,

In order to change a current custody order a complaint for modification must be filed and through evidence presented to the judge, you must prove that a change in circumstances has occurred and that the best interests of the child requires a change in custody.

A custody case is often long and complicated. I would recommend you speak to a family law attorney before filing any paperwork with the court.

As the previous attorney stated, you will need to bring a complaint for modification and demonstrate that a change in circumstances has occured and that it is in the best interests of the child that there be a change in custody.

You will need to be ready to clearly state what change in circumstances has occurred and present evidence on your behalf to the court. If you do not yet have a custody order in place, it may be appropriate to file a complaint to establish paternity or simply a complaint to establish an order of custody, visitation, and support.
