Technically, the answer is no.

My advice would be to sit down with the other party and come up with a visitation plan that works for both of you, then hire a lawyer to file the paperwork for you. If not, you could have a visitation order forced upon you. If there are safety or domestic violence issues, I urge you to contact an attorney.

Best of luck!

Tecnichally no, but if you do not reach an agreement, the court may order terms you will find less acceptable than what you feel is best for the child. Absent a compelling reason such as drug abuse or something else which is equally wrong, your ex or soon to be ex will have visitation. Also, do not make up or make claims against your spouse which cannot be proven. If you make false or un-proveable allegations, your suitability as a parent will be questioned.

Good Luck
