Legal Question in Family Law in Massachusetts

Giving up custody

I am a divorced father of 3. My court order only allows me to see my children every other friday. My ex is controlling and unwilling to allow me to see my children outside of the described times. I am emotionally and mentally exhausted and want to give up. How do i go about giving up custody as it will improve the mental stability of myself and my children

Re: Giving up custody

Do not give up. Your children need you.

Retain an attorney to file a complaint for Modification to seek more favorable visitation. Good Luck!

Re: Giving up custody

You can certainly waive your visitation.

If there is a reason for your limited visitation, your ex has a right to keep you within same so long as that reason continues to exist. If it is simply a "bad deal" you made, or the reason no longer exists, you should go back to court and seek better cooperation. Your children need you to continue if you are fit.
