Grandparent Violating Visitation??

My brother does not have custodial or visitation rights (no court-ordered visitation schedule) with his child. The mother has sole legal and physical custody. The parents were never married. The child's paternal grandmother (my mother) has visitation with the child (grandchild) and allows the non-custodial father (my brother) to see the child without the mother's knowledge.

Is my mother in violation of her visitation rights???
