Grandparent Visitation

Is it true that because my Son is still married to, and living with his wife,I can not petition the Courts for visitation of my 6 month old grand-daughter?

Re: Grandparent Visitation

The grandparent visitation statute only allows the court to grant grandparent visitation if the custody of the child has been addressed by the court in another proceeding such as a divorce. In your case, the statute will not allow you to get visitation. In addition, there are substantial questions about the constitutional power of the court to grant grandparent visitation over the objection of both parents.
