Legal Question in Family Law in Massachusetts

I was granted a divorce on July 16, 2012, but in the state of Massachusetts, there is a 90 day waiting period before it becomes absolute, which will be on Oct 15, 2012. Would I be able to obtain a marriage license and get married during the waiting period or will I need to wait until it becomes absolute?

You are still married until October 15, 2012. If you get a new marriage license, you will be committing the crimes of perjury and bigamy. Perjury is lying under oath in that you have to state on the application that you can get married. Bigamy is getting married while you have a spouse.

You need to wait until October 16 to get married.
