Legal Question in Family Law in Massachusetts

Are Guam divorces recognized by state of MA?

Will this supposed quick way out for an uncontested divorce be recognized by the state of MA for 2 Massachusetts residents? One will do the required 7 day stay in Guam.

Re: Are Guam divorces recognized by state of MA?

What is the problem with an uncontested divorce in Massachusetts? The Separation Agreement can be prepared and heard quickly. The divorce will be final in about five months from the date that the papers are filed.

Massachusetts recognizes all divorce decrees lawfully entered by a jurisdiction. However, the "Guam" scenario you suggest sounds quite questionable. In addition, if you have children, there is no jurisdiction in Guam, regardless, and you will need to handle matters here through some action.

Unless you are in some crazy rush to get remarried -- which may cause more problems than you need if the Guam divorce is later questioned -- I would suggest accepting that Massachusetts is the appropriate jurisdiction.
