Legal Question in Family Law in Massachusetts

Guardian Ad Litem?

A GAL was appointed to decide custody in my divorce case. In our initial interview/appointment, the GAl met with my and the children's longtime babysitter. During the interview, the GAL told the babysitter that she looked familiar and asked where she worked. The babysitter told the GAL her place of employment. The GAL responded that it was not a ''good'' thing. Come to find out, the GAL had a run in with the babysitter. The recommendation from the GAL are 100% against me and I think it is due to her conflict with the babysitter. Is this a conflict of interest and should the GAL have remove herself from the case?

Attorney Lebensbaum's advice is very good and directly on point. Depending what those first two steps reveal, the Attorney has a number of ways of attacking the report, including seeking appointment of an alternative GAL.

There are several steps:

1. An attorney would have to review the report;

2. Then discuss the facts and events as you see them, and then speak to the GAL;

3. Then you can develop a strategy to deal with the adverse report;
