Legal Question in Family Law in Massachusetts
guardian ad litum
If a GAL is found to be extremely bias in her findings regarding a custody battle, other than at trial, what recourse does someone have against them? The GAL in my case has misrepresented at least 5 different people in their official report against me and therefore, has recommended the custody of my children to be terminated. This case has not gone to trial yet and is due for a pre-trial in the next few months.
Any help would be appreciated.
thanks,
mike

Re: guardian ad litum
Going against the GAL is no easy task; I would hope that you have an attorney, and that you can get a comparable evaluation or get the contradictory information by the time you get to trial. GALs have been given an aura greater than they deserve. If they are also attorneys that they are governed by their rules of professional conduct governing their representations to the court; other GALs have other governing bodies, some do not.
