Guardianship

My husband have sole physical custody and joint legal custody (but in the event that they disagree, he has the FINAL say) I have been raising my step-son since he was 6 months old, his bio mom has visistation and is suppose to pay child support but doesn't, she is not willing to give up rights, he is on my insurance and has been since me having him. When it comes time to register him for school my husband has a job where he can rarely take off, and in MD, the schools will not allow me to register him since my husband is the legal guardian. Can my husband award me temprary or joint guardianship in order to register him for school or other things? how long is a temp guardianship for? stepson was removed for neglect reasons, so in the event something happens to husband can there be legal paperwork that would award step-son to me and not mother because of neglect?

what are our options?

Your husbsnd can give you a temporary guardianship. While the balance of your question is too complex to answer here, I suggest you and your husband confer with his divorce attorney or a new attorney as to how to deal with your desire to take more active and legal role in your step-son's life.
