Legal Question in Family Law in Massachusetts

guardianship issue

I have 2 children living with me ages 17 and 15, their mother can't take them because she's been evicted and has no room where she now lives so she cannot take them. they are involved withh dss before the eviction, and now the state labels them as abandoned and wants to put them in foster care, are there any options I have to keep them from going, I am realted to both as a half cousin. can I keep them somehow or can they choose other relatives to live with with out their mother's consent.

Re: guardianship issue

The 17 year old can pretty much live wherever s/he wants to. The 15 year old can have a say in adoption or guardianship if you want to apply to adopt or serve as his/her guardian. DSS could consider you for a special foster care placement. Have you asked?

Since you do not offer your age, marital status, employment status, child care experience, etc., I cannot really offer much more.

You should consult a lawyer who can ask relevant questions and get immediate answer to evaluate your and the children's situation. I have been doing these cases for 30+ years.
