New CS Guidelines

Ther new child support guidelines specifiy that the custodial parent will be responsbile for the first $250/child (the old CS guidelines were $100/child). Will this provision apply to me and my ex when it comes into effect 1/1/09?

Re: New CS Guidelines

A specific order overrides an expectation set in the Guidelines. If there is no specific order, I would suggest that the non-custodial parent could reasonably argue that the new expectations should apply. Most orders written in the past have simply ignored the "first $100" rule, however, and required simple equal division of the support. That would be a specific order overriding an expectation set in the Guidelines.
