Legal Question in Family Law in Massachusetts
health insurance for ex wife
Went to lawyer with divorce papers and was told I didn't have to pay for ex wife's medical. She was to pay me each month. He sent her a certified letter stating she was to respond by March 1 if she wanted to stay on my insurance. She said yes. I told my lawyer tell her no personal checks. Her checks always bounce. He said ok. He sent her a letter stating if she didn't pay me the premium by the first of every month she would be dropped. We'll she never paid me. I called him and told him. He said DROP HER! Now she calls my lawyer, tells him she never received the 2nd letter and she didn't know who or where to send the check. He calls me and tells me to reinstate her and make arrangements to get my money. I have been paying her share of the premium for well over 16 months before going to him to find out about my rights. What do I do now? First he tells me to drop her then he tells me to reinstate her. He said she can take me back to court. I just don't get it. Did I get the wrong lawyer? Can she take me back to court? When I showed him the divorce papers the part about the mediccal insurance was not typed in. It was handwritten in if that's any help. Thank you.

Re: health insurance for ex wife
The issue here seems to be communication and advice, versus getting a court's opinion. You should seek counsel to file a modification or contempt action, legitimizing any health insurance action. The contempt action would be to require wife to pay her cost.
