Legal Question in Family Law in Massachusetts

Hello!

About 3 years ago, 2007 - a friend moved to Boston, Ma (Randolph, MA.) to be closer to his sons and assist them in graduating high school, they were becoming troublesome to the mother. The kids graduated last week from High School, he pays monthly child support and is obligated until they are 23 years old. Now, the mother of the children is taking him back to court for assistance with College tuition and expenses. What are his options, the boys work and will be attending college free and living at home.. What should he do? Is this possible that he would have to pay more money, he is retired military, he never married the mother and half of his retirement goes to her.

What portion of college tuition/expenses, if any, your friend would be ordered to pay depends on several factors. If in fact the children's tuition is free, then your friend would most likely not be ordered to pay anything. If the children are enrolled in full-time post-secondary studies and there do have to pay tuition and expenses, depending on his financial situation and the mother's financial situation, he can be ordered to contribute to those costs. The fact that he was never married to the mother would have no legal significance with regards to his financial responsibility for the children's support and college expenses.
