Home Schooling

I am a bit confused here on the judicial system. I have sole physical custody and legal joint with my ex. I live in Massachusetts and I was home schooling my youngest child who loved it and had a great social life for I saw to that. He was ahead of his peers and I was using the school curriculum and was approved by the school board and superintendent. My decided he wanted public and then it was up to the judge to decide and she went for public schooling. How can this be where it is legal to do and I am also very educated with 6 years of college.

The entire premise of joint legal custody is that both parents get to decide the welfare of their children. If any issues are to arise where neither parent can come to an agreement, then it is up to the court to decide based on the best interest of the child. In this case, the court has decided to grant public schooling to your child.

If you don't like the decision, you can appeal it or try to go for sole legal custody - both of which are unlikely to go your way.

In these disputes, the court has final say what is in its view as in the best interest of the child.
