Legal Question in Family Law in Massachusetts

My husband left the house we bought about 8 months ago. I am wondering if we are to get divorced what would happen with it because his father (my father in law) is on the deed and mortgage. We did this for financial purposes at the time(although he wasnt suppose to be on the deed just the mortgage). We have been married for 4 years and have a 6 year old child. Will I be forced to leave the house? The house is a multi-family and pays for itself. His family has plenty of money to pay for lawyers and I don't. My husband has had drug and alcohol problems and I am tired of dealing with it. I'm not sure where me and my children will end up as I was working for his father and now he is telling me I dont have a job. Any info would be greatly appreciated.

It is not likely that the court will make you leave the home on the basis of the divorce. Your father-in-law could however seek to partition the property, which would divide it or result in sale of part of the multifamily or its split.

I agree that you should retain an attorney to assist you in sorting out and protecting the interests of all the parties involved. It sounds as though your ownership interest in the property is at risk because of how you have arranged your affairs.
