My husband has a ten year sentence and he has served five years of it. I am ready for my divorce, however, during the time of his incarceration, I have gained a stock portfolio that is worth some significant money. Does he automatically get half of that eventhough he was in jail during the time I gained this asset?

No. He does not automatically get half. The court will balance all the facts and determine what is fair. A number of factors are relevant including how long you were married and how much each side contributed to the acquisition of assets during the marriage, amongst other things.
