Legal Question in Family Law in Massachusetts
Ex husbands death and support
My ex husband just passed away very suddenly. When we drew up divorce papers he was ordered to take out a 100k life insurance policy just in case to help support our daughter. He did not do this. Should I legally take steps to attach the estate or is this a null issue now.

I am located on the border of Norfolk County and Suffolk County. Please let me know if I can be of any assistance, or if you would like me to recommend an attorney in/near the county where your ex-husband was living when he passed away.

Yes. If there is an estate, you would likely have a valid claim. However, a review of the court order would be required for a more clarity. If he died in Mass, then you need to retain a Mass attorney in the county where he died to deal with the probate court.

The prior answer is directly on point.
Be aware that you may have time limits, especially if a probate of the decedent's estate has been commenced. You should should contact a skilled PROBATE lawyer, one who concentrates in handling estates.
