Legal Question in Family Law in Massachusetts

Can my husbands legal guardians sign an affidavit of non -paternity legally?..FYI... they are guardians over only his person and not of his estate, but i don't think my unborn child counts in that dept..so for the affidavit, when my child is born considering we are still technically married can they sign this with out issue? He is not a capable person being that he resides in a nursing care facilty and requires legal guardians for everything for himself ...just wondering if they can also sign this document for me after i give birth to my child from another father. thank you for your info..

A guardian is obligated to protect the interests of its ward. If your husband is the father, then there should not be an issue of paternity. However, I suggest you contact an attorney with all the relevant facts and seek appropriate advice.
