Legal Question in Family Law in Massachusetts

My hushand and I purchased a home that was in his family. We bought his brother out, now we are seperated is this a marital property or his home.?

All assets acquired during the course of the marriage are considered to be part of the marital estate. What portion of the marital estate each party receives depends on many factors. With regards to the home that you and your husband purchased during the course of your marriage, that would be considered part of the marital estate which would be divided in a divorce. The fact that you purchased the home from a member of his family should not be an issue.

Attorney Urukalo is correct. All property is potentially considered part of the marital estate, and a judge will apply a number of factors in making an equitable (fair) division of the assets/property.
