Legal Question in Family Law in Massachusetts

infant visitation/out of state

My ex-boyfriend lives in another state. I left him before having my daughter and moved to MA to be near my family and to escape his drug/alcohol/verbal abuse. My daughter is now 5 months old and he has seen her once. Also, a few months ago he was arrested on DUI (he hasn't been in trouble for drug/alcohol abuse prior to this so nothing is documented..only what I saw)...I am taking him to court in MA to set up a visitation/CS order (I wouldn't do it, but he has forced the issue and taken action against me)...with his background (but only 1 documented incident) what can I expect in regards to visitation with my daughter? supervised/unsupervised? because we live in 2 different states and travel by plane is necessary will my infant daughter have out-of-state visits with him? She doens't know him and is so young anyway...What typically occurs in MA courts for a situation like this?

Based on your brief statement, and documentation of his DUI, the court is likely to limit visitation to supervised visitation in Massachusetts. You will have to prepare a detailed statement of his history of alcohol, drug, and abuse of you. The Court is unlikely to order that a child that age travel, especially if you are placed in harm's way thereby.

You should engage an attorney and do this the best way possible. It will cost you less to do it right now than later.

You should also vigorously pursue child support in Massachusetts, if at all possible.
