Legal Question in Family Law in Massachusetts

Infidelity

Once a couple has seperated, is it considered infidelity if one person is dating? Is there any point in finding out about suspected past affairs? Would filing for a fault divorce based on infidelity improve my chances for getting some alimony?

Re: Infidelity

There is no judge in Massachusetts in 1999 who is even going to blink

if you use adultery as grounds for a divorce.

Alimony is based on many factors. You don't have t

to go the route of adultery to get it.

So there is no "point in finding out about suspected

past affairs." There's been only one case I know of in

recent years in which the divorce was granted

on the grounds of adultery. In that case, a very rich and very famous

husband settled with a large lump sum payment. Is your hubby rich

and famous? If so, call me.

If not, think of all the happy things you can do

in your life without him!
