Legal Question in Family Law in Massachusetts

inheritance

my husband left me about 7 months

ago, i have three children in their 20's

all living at home. His mother is in an

assisted living and he is POA. They

are starting to liquidate her assets.

Am I even though not divorced entitled

to some of this money. We have been

married 25 years and he does not

want to live with me ( i believe

another woman is involved 750 phone

calls a month for the past 9 months

she supposedly is just a good friend!

She has stated she is in love with him.

He said a while ago he does not want a

divorce and does not want to sell our

house he just doen's want to live with

our family any more he stills see the

kids ocasionally on the weekends at

the home he is living in now. . I shall

not file either as I still love him and

would take him back. BUT i am not

stupid, those phone calls emails text

message have upset me and i don't

have the trust i use to. What are my

rights to this money and if I wanted to

sell this house we both own can i do it

without him since he left 7 months

ago and hasn't returned.

Any money or assets received by either party during the marriage are considered marital property subject to division by a divorce court. Retain an attorney before it is all spent.

You raise some complex issues that cannot be entirely answered. Before the filing for divorce, there are actions that each spouse can take, which are not available once the divorce complaint is filed. You should really contact an attorney, or contact me, and each issue can be specifically addressed.
