Legal Question in Family Law in Massachusetts

inheritance/divorce

My father reently died and left his estate to my older brother, sister, and me. His estate includes properties and annuities, and is clearly outlined in his will.

Before my dad's death, my husband separated from me and is planning on divorcing. He feels he will be entitled to half of my share of my father's estate. Is this a possibility?

Sadly and unfortunately, it is likely he will be entitled to something. However, there are many things that factor in... i.e. length of marriage, etc.

If you have not yet, you should seriously consider hiring a family law attorney that is familiar with asset divisions.

I agree.

Just to elaborate, until and unless the legal proceedings are complete, any property that you acquire is marital assets subject to distribution.

The extent of the division is determined by the court or by agreement between the parties.
