Interrogatories

Five days ago m y husband's atty. sent me a list of interrogatories. There are a few that are difficult to answer, as it will require my spending money to get medical records (I am umemployed; it may cost $100-$200 to get all records and I may not get them in time). Is there any way I can get around this? Plus, they're asking for my daughters' employment histories and schedules. Both daughters are 18 and 20 years old, adult age. Do I have the right to give this information without the girls' permission? (the girls will not give their permission).

Also, should I send my husband's attorney interrogatories? I am representing myself in this divorce. thank you.

Tell them (1) that you are not in possession of your medical records, (2) that if your medicals are an issue in the divorce, then you can or will give them authorization to get them themselves, or (3) that you will supply them after you receive from the atty payment for the copying in advance -- because you do not have the money to put out, provided that is truly the case.

As for your daughters, the atty can subpoena the employment records if he wants them. Whether the companies give them to him is something else.

It is for the girls to decide whether they will give permission. If they are still UNemancipated and (a) he is seeking their emancipation or (b)he is seeking a reduction in child support because they are not in school full time, he has a right to those records, to prove that they are employed and are not relying solely on you for support.
