Legal Question in Family Law in Massachusetts
I am currently involved with DSS because the high school called them back in May 09, due to my daughters poor attendance. She will be 16 in 2 weeks, and the law in Massachusetts says they must attend school until age 16. I want to sign the papers for her to quit when shes 16, I can do this right? I dont believe the school or DSS can do anything if she quits, because of that law. Also, they are only involved because of school attendance, and we have cooperated fully with them. I have asked for our case to be closed in December when my daughter is 16, why would they need to keep it open for after that? Can I file anything if they wont close the case when shes 16, or is there anything I can say or do to help this process along? Im not telling them shes giong to quit, because I do not trust them, im just going to sign the papers the day shes 16. Because the law says she only has to go until shes 16, I can sign these papers right? What can I do to get rid of DSS? I want to know what im talking about legally, incase they try lying to me.

Yes she can quit at 16-however, DSS (DCF) can keep the case open until they complete their investigation. If you as a parent have done nothing wrong then you dont have to worry-however you may want to retain an attorney to keep them on guard.
