Could he get joint custody?

I am the fiancee of the father of the child. He is 15 months old.

The mother and the father of the child have a strained relationship. The mother will not allow the father to see his son, she always has an excuse. The father has tried to be in his son's life the whole time, but she makes it very difficult. She denies him of seeing his son, especially when she is angry at the father. He does not have a job, but is currently searching for one and goes to school. At one point, they got along and the father was able to see his son at least once a week. But now, when he attempts to talk to her about seeing his child, she starts a fight with him and then says that he cant see his son. The father wants to go to court, but is looking for a job so he can pay child support, since that will be one of the things that the court tells him he has to do. The father does have 3 A&B charges that have already gone through court. What else is the court going to have him do (supervised visitation, etc.)? Is he still able to get joint custody of his child? Could he bring it to court now, or should he wait until he has a steady job?

The sooner he goes to court, the better. if he is looking for a job, the court may actually be able to help. The courts are aware that joblessness is at an all-time high. based on your apparent location in Western Massachusetts, I have to assume that the economy is not doing him any favors.
