Legal Question in Family Law in Massachusetts

joint legal custody

I am a single unwed father living in massachusetts I split with my ex 10 month ago since then I have been giving her a resonable amount of $ each week I am now filing for joint legal custody, visitation and order of child support I have spent all my free time and vacations with my child i adore her she is 2 years old. 10 years ago my ex lived in Fla. with her sister If I am granted JLC. will that prevent her from trying to move back there with my daughter or do I have to adress the issue at the mediation hearing i just want to protect my relationship with my child.

Address the issue at the hearing it never hurts to have it in the agreement.

Assuming there is a legal action pending, the mother needs the permission of the court to relocate. If you are concerned about it, then you MUST file a paternity action, yesterday!

Retain an attorney to file a paternity action to seek joint legal custody. It will not guarantee she could not get the court's permission to move out of Massachusetts if she can prove the move would be in the best interest of the child, but it will improve your chances of opposing it. Good Luck!
