Legal Question in Family Law in Massachusetts
Keeping us together.
My boyfriend and I have been living together for 4 years now and have a 2 year old girl. He also has 2 boys from his wife they are 5 and 7 years old. He has not lived with her in a little over 4 years and has been paying her child support first in $80/week (by my checkbook) even though we had them 3 to 4 days a week. She ended up getting it taken out of his checks about 2 years ago right before she asked us to take them more because she needed a brake. All of the kids are insured through his job, have been seeing the same Doctor in our area, and going to school together sense last September. The boys mother loves them but has several issues actually being a good parent to them. I hate to say ''unfit'' but ... she lives with her sister and her three kids in a 2 br trailer with plus pets. While we can only afford a 2 br apt. they each have their own bed and no pets. Will it be difficult for him to get coustudy of the boys so at least we know she can't just show up and take them away from us, school, Doctor, and friends. Due to our current situation we are living on a very tight budget, is there assistence out there for fathers in his position? I love my family and this struggle to keep it together needs to end. Based on what you present, it shouldn't be too difficult to have the court transfer primary physical custody based on the fact that the children have been living with you for the past two years... basically asking the court to recognize the de facto situation.
