Legal Question in Family Law in Massachusetts

kicking out 18-year old son

My son is 18 and cannot hold a job, is stealing, lying and smoking weed in the house, etc. He has had lots of chances but we are concerned about our other 3 minor children and want him out. Legally can we kick him out?

At 18 years of age he is an adult and you can tell him to leave your home.

Re: kicking out 18-year old son

An intact family has no legal obligation to provide for an 18-year-old child. If you are divorced, you could arguably be required to continue to support the child on proper motion by the other party (if the boy moved in with him or her).

You also have the legal obligation to protect your minor children from any serious risk of harm at the hands of an adult, if you know of such threat. Thus, depending on any additional behaviors, you might arguably be -obligated- to tell him to move out.
