Legal Question in Family Law in Massachusetts

Kids moving to CA

My ex wife is moving to CA July 22 with our 2 kids, and it states in our divorce agreement that she can move. It also states that I have the kids for the summers. Can I keep the kids for the rest of this summer?

I hope that she has a court order, unless you gave her permission.

If she lacks either of the two, you need to rush to court, and get an order to stop the move.

Call me.

Assuming you've stated all the terms of your Separation Agreement correctly, namely, that you've already agreed that she can move out of state with the children and that you're entitled to spend summers with your children, then YES, you can have the kids for the rest of the summer.

However, you should contact the attorney for your divorce who helped you draft the Separation Agreement since there might be nuances in there that you might have misunderstood or maybe even drafted vaguely. Without seeing the Separation Agreement, no attorney can answer with 100% certainty your question.
