Re: Lack of full disclosure on financial statement

Thanks for your previous reponse.

I do have material information to prove that she has falsified her financial statements several times.

My question is: what exactly can a probate judge do to sanction her? Or is this just a vacuous power of the judge and they never do anything?

The judge has the power to sanction. You will need to file a Motion for Sanctions under Rule 37 and Rule 401. For the judge to take note, the falsification has to be more than the usual "minor" omissions, such as failure to note the wedding ring and such. The failure must be about either income which would significantly affect child support/alimony considerations, or property which would materially affect the property division.
