Lawsuit against her attorney
I'm in the divorce process. We created a Stip in August 08. One clause says I am to cooperate for her refinance of our home. From Aug 08 until April 24 2009 nothing about the refinance was mentioned. Then 6 hours prior to the closing of the refinance I was notified by my attorney that I was to drive halfway across Massachusetts to sign papers. I was very suspicious and needed time to digest what was going on. Her attorney filed for contempt and lost over a technical ambiguity in the Stip but it cost me $2000 to defend. Can I sue my wife and her attorney in small claims? The bank attorney says her attorney was notified 2 weeks prior to the closing but notified me 6 hours before the closing.
The real question here is; How much notification is warranted to deem the inaction of me not attending the closing as uncooperative?
