Legal Question in Family Law in Massachusetts
Lawyer Conduct
Ex & I in court on divorce contempt. Ex's lawyer after signing in to see moderator leaves to go across street for another case (gone 45 min). Moderator calls us, gets sidetracked for appx 20 min & luckily ex's lawyer returns while moderator talking to other person saving us from having to get in line all over. during Mediation Ex's lawyer answer cell phone, moderator sends lawyers to talk to clients & ex's lawyer leaves again returning 1+ hr later - mediator left for lunch now 2+ hr wait. 3 go back into mediation she continues to anwer cell -- shouldn't the mediator and/or my lawyer stopped this. Shouldn't this have been considered default, made ex represent himself, go in front of judge. I feel something should/could have been done that ex's lawyer shouldn't been able to leave for another case, take calls, etc. (this costs me extra fees/hours). My lawyer told me to write to BBO to complain so she knew it was wrong/inappropriate. Could I have stepped in and did something about the lawyer leaving if my lawyer or the moderator didn't. I want to know for the future if the ex brings the same lawyer next time what my rights are. We ended up in front of judge at 4 from 8 & I got what I went in for x's lawyer just stalled
