Legal Question in Family Law in Massachusetts

If I leave the marital home because we are getting a divorce, because he will not leave, if I stop paying the utlities which I was responsible for does that mean I will not get any monies from the sale of the house?

Hello,

By leaving the marital home and no longer paying the home expenses does not in itself bar you from receiving funds from the sale of the home. What portion you get of the equity in the home depends on several factors. I strongly recommend prior to making any decisions you consult with a divorce attoney.

No. Your share of the house and other marital assets will depend on many factors.

Retain an attorney. You may not have to leave the house if the Court orders your husband to do so. Good Luck!
