My sister is in need of mental help and has 2 children one 9 and the other is 4. She yells at them all the time and the 4 year is still in diapers which is not right. She needs to seek mental attention! My parents and I have tried talking to her and she is in denial and last night her husband called and said that she attacked her with a knife! What can we do legally to get her the help she needs? Or do we have no choice but to call DSS?

Go to the District Court on Hurd Street and talk to the Clerk's Office about filing what is called a "Section 12" if you believe that your sister has a mental problem. Otherwise, talk to an attorney BEFORE you get DSS involved.

Do not rush to take an action.

I thing that step as a first one is wrong.

You need to realize the consequences of any action. Running to the district court without viewing or reviewing this matter is simply wrong.

There are several options. One of the options is to go to court and possible seek a guardianship.

GOing to the district court requires a showing of not only a mental health problem, but some imminent risk of harm to your sister.

DSS should be the last choice.
