The legal guardian is the mother. If a man has not been adjudicated the father via a voluntary acknowledgement of paternity or a DNA test, he essentially has no say in anything relating to the child. Even then, he must file the appropriate documents with the Probate and Family Court in order to obtain custody and parenting time.
