Legal Question in Family Law in Massachusetts

I would like to know if I get a legal seperation or divorce from my spouse, would I still be legally or financially held accountable for any debts that my spouse incurred after we were seperated or divorced?

If your attorney prepares your divorce paperwork properly, you will be able to deal with all current debts and obligations. At a minimum, you should refinance or close any joint accounts. You will also be able to clearly spell out how any ongoing debts or obligations are to be handled. My office charges a simple flat fee for cooperative divorces, and you should feel free to contact us if you would like to discuss. 617-357-4898.

If your separation agreement is done properly and you follow through with your agreement and close all joint accounts and all joint credit cards, then you will not be responsible for any debts incurred after the divorce. This will not protect you from debts on which you are obligated now as a co-signor or guarantor.
