Am I legally divorced?

I have been married for 12 years, and we have a thirteen year old son. My son and I have not lived with my spouse in the same domicile for nine years. My spouse has dated several people over the years, and I have no desire to reconcile the marriage. Am I legally divorced due to the amount of separation time. I just want out of the marriage at this point.

If you were legally married you remain married until divorced by a court of competent juridiction, regardless of how long you have lived apart.

Retain an attorney to file a divorce complaint under which you will also be entitled to child support.

No you are not divorced. You can file for divorce with very little effort.
