If not legally separated, but living apart, can a parent take a child out of state for a vacation without the other parent not agreeing to this.

If nothing has been filed in any court relating to divorce, seperation, or custody of children, then each parent has the right to travel out of state without permission from the other parent or a court. Of course, the question should be asked, what parent objects to the child going on vacation?

As Mr. Pransky said, unless there is a custody order, each legal parent has equal rights to the child, and does not need permission. Traveling out of the country can get a little messy, but within the US, there is no issue.
