Legal Question in Family Law in Massachusetts
I live in Massachussets, the custodial parent has been living in Florida for 17 years. Our original child support order was entered in the State of MA in 1996. The DOR has ended my child support order as of 8/31/2013 as my youngest turned 18. She transferred the original order this year to the state of Fl and is asking them to extend the child support to age of 23.. case is still pending. Now she has filed for a new order in the state of Massachusetts. Which state has jurisdiction?

Depending on how long the child has resided in Florida, and whether an action has properly been commenced in Florida, the action is most likely appropriate in Florida, and not in Massachusetts. It is my understanding that Massachusetts would also be proper as a court of continuing jurisdiction, but that an action in Florida would preclude a subsequent action here.
