Legal Question in Family Law in Massachusetts

Lost Custody of son for 30 days

I have a friend who moved into her mother's house several months ago. She had just broken up with her fiance and moved from Georgia and moved in with her mom and she helped her out with her two kids . She has a son 9 years old and another son 2 years old. She got into a fight with her mother , verbal not physical and sh kicked her out . Three days later she went to the court house and got temporary custody of the 9 year old saying that she is on drugs and isn't living in a stable environment. Cause at the moment she is staying at her ex-fiance's studio apartment cause she has no other place to go. The judge issued the 30 day order and she has temporary custody. She has been smoking weed and is afraid to go to the courthouse.

She has a court date of the end of this month. What can she do . What are her options?

This is indeed a problem. Sounds like her mother got a restraining order. Usually it is returnable within 14 days. Of course, this could have been a matter before the Juvenile Court. It is important to know which one.

Your friend needs to consult an attorney ASAP. She needs to discuss the events, and her history with this lawyer, and mount a response to her mother's allegations.

Without reviewing the court documents and consulting your friend it is hard to give her the options.
