Love Child, Support & Custody

I am the father of a "love child", whose mother and I for all purposes never had a real relationship. She never wanted my involvement in their lives, and I now live in another state. I see my son approximately once a year. There never was any "written agreement" as far as custody & support like in a divorce. However, my son is fast approaching his college years and his mother can't afford the schools she wants to send him to. She has asked for help and I have agreed. However, she has since changed her mind and is going to use the courts. She never wanted anything from me - money, involvement, etc. Can she get back support by going through the court? What legal ground do I have in support of the fact that she didn't want me involved in their lives? Do I need an attorney from MA or from the state in which I live? Thanks for any and all help!

Your question at this moment (6/17) is unanswerable. You might be able to use a lawyer in your state who can enter Mass. pro hac vice. YOu might need local Mass. counsel, but it's too early to tell.

It appears your ex-GF still (1) needs to prove you

are the father of her son or (2) needs to

produce a judgment or order informing you of an

amount to be paid, to whom, and with what

frequency.

If she has been on welfare, it will be up to DOR

to go after you, not her. That is, the Dept of

Revenue has to come after your funds to reimburse any monies the

state the monies it has provided her on behelf of the child.

But what you have

said makes me believe (1) she was self-supporting and

(2) she's trying to scare you off, and (3) you haven't given us the whole story.

I smell more...and if there IS more, do NOT expect to get any answer that's worth any more than the paper it'll print out on.
