Legal Question in Family Law in Massachusetts

Ma child support contempt

What can happen for being 6 wks late on ch support, when go to court for contempt in MA?

I am taking my son's father to court on a contempt charge for only paying twice on his support order, and not providing insurance yet. We already agreed when they issued the order that the money from the date of filing would be added to weekly support, I know I may sound mean, but he has never been ordered to pay before now and has never paid, and my son is almost 12, By the time we get to court he will be about 10-12 weeks behind, will the court just add this to the arrears too, or order him to pay up?

The owning parent can pay the arrears on or before the hearing date. Or the court , if arrears are unapid, will order an arrears order, and a due date for payment. The issue of capacity to pay may come up. The court also has the discretion to change the child support order. if the facts warrant this.
