Legal Question in Family Law in Massachusetts

Mandatory Parent Education Courses

In the state of Massachusetts it is required by law for parents of minor children to participate in a 'Parent Apart' course which teaches parents how to help their children cope with the divorce. Since it is a mandatory course, in order for the divorce to happen both parents need to participate. My question is, the other party failed to attend this course, therefore the court will not provide me with a court date until she does it. I'm suppose to file a motion to compel, but I can't figure out how to do it, or what the motion should even say.

Re: Mandatory Parent Education Courses

The court has motion forms. They should be online; look for the Probate and Family Court Main Administrative Office using a web browser. All you need do is write in the blank, "To enter an order compelling Husband to complete the Parent Education course within sixty days." File this, and seek a hearing under the particular Probate and Family Court's procedure (you will have to call the Register's Office).

Best of luck.

The Probate Court has forms and the registar should help you File a Motion to Compel attendance at the Education Course.

Good Luck.
