Marriage during divorce NISI

My wife and I got married before the NISI period of her previous divorce expired. We have been ''married'' for 4 years now. Is there any waiver or any way the marriage could be legalized now. Would we have to get married again?

I agree that your marriage is void under MA law. However, if you really want to clear up your life, you might want to seek an annulment of your marriage based on bigamy and then get remarried after the court grants the annulment.

To make matters fully legal, you should get re-married in a simple civil ceremony. This is quick and inexpensive, compared to seeking an action to affirm the legality of the marriage (especially as I think a judge would have to determine that your marriage is not legally valid).

Your current marriage would be deemed void under Massachusetts law, as I understand matters. I do not believe it can be "ratified" in any other way. If I am corrected by someone who has actually checked the law, I will humbly apologize.

Look on the bright side: your wife gets an extra anniversary date to expect you to remember every year.
